Rules, Regulations, Forms, Fees and Official Policy Statements

The District is established pursuant to the NJ Soil Conservation Act, N.J.S.A. 4:24-1. The full text of the statute is available on the NJ Legislature website. (www.njleg.state.nj.us.)

The district is governed by regulations adopted by the NJ Department of Agriculture State Soil Conservation Committee. The regulations are codified at N.J.A.C. 2:90-1 et seq.

With few exceptions, most District records are available for inspection and copying by the public. Many of these records are already posted on this website. The New Jersey Open Public Records Act (OPRA) requires every NJ public agency to designate a “Custodian of Public Records” (CPR) who is responsible for responding to all requests for public information. The District’s CPR is the District Manager. Records may be requested by using the form below. We ask you to be as specific as possible in making your requests. Photocopying fees may apply. Special fees may also apply for copies of maps, plans and other large documents. Similarly, special fees may apply in the event that the request requires additional man hours to compile records or statistics or reports.

Conservation Agreement

1) Policy Adopted 10/22/2014. Effective 1/1/2015, any and all new SESC applications that include either an aboveground or underground stormwater basin or other facility, shall include with their application a CD containing a copy of the Stormwater Report and a pdf file containing the engineering drawings for said stormwater facility. No SESC application with an engineered stormwater facility shall be considered complete without such a file.

2) Applicability of Soil Erosion and Sediment Control Act to Single Family Home Construction.  The State Soil Conservation Committee has issued new guidance effective 1/1/2015 that clarifies when the construction of single family homes are subject to the Soil Erosion and Sediment Control Act. The guidance includes a flow chart and frequently asked questions. The NJ Permit Extension Act expired on December 31, 2015. All District certifications and approvals that were previously found eligible for extension are now subject to the normal District recertification process. Please feel free to contact the District office if you have any questions relative to expiring approvals under the NJ Permit Extension Act.
